How long will it take to receive a decision on my visa application? Can I track its progress?

The majority of applications submitted from overseas have a standard for processing times of 3 weeks after the applicant attends their appointment at the visa application centre. Particular applications have a standard processing time of 12 weeks after the enrolment of the biometrics.

You might wait longer for a decision if your application is not straightforward and more information is required before a decision is made (for example your supporting documents need to be verified, you need to attend an interview, because of your personal circumstances and immigration background).

You cannot currently track your individual visa application online.

I am a senior citizen aged 65 years old. My son has been living in the UK for the last 15 years with his family. They all got British citizenship. I am a retired person and living alone here in India. My two married daughters live here in India with their families. I visit the family of my son once a year on a visitor’s visa. My query is whether my son can apply for a dependent visa for me for permanent stay in the UK Or is there any other way so that I can stay with him permanently.

The Immigration Rules include an Adult Dependent route, which provides qualifying applicants with the opportunity to live in the UK with a close relative on a long-term or even permanent basis. However, these visas are generally only granted in restricted circumstances. The purpose of the route is to allow an individual with ongoing care needs to live with a close relative in the UK (sponsor), provided the applicant can show, as a result of either age, illness or disability, that they require a level of long-term personal care that can only be reasonably and adequately provided in the UK by their sponsor and cannot be reasonably and adequately met in their home country. Unfortunately, refusals are frequent and only a small proportion of applications are successful. Comprehensive legal advice should be sought before submitting an application on this route as a refusal can have a negative impact on any future applications.

I am an entrepreneur. I have been running my business successfully in India for the past five years. I am into the manufacturing business of handloom products. Now, I am planning to enter into the international market. Please suggest licenses required for the nature of my business in the UK. What is the procedure and time required to complete the documentation?

The UKVI has confirmed the introduction of a new route called Global Business Mobility which will be launched in early April 2022. The Global Business Mobility – UK Expansion Worker route allows overseas workers to undertake work related to a business’s expansion to the UK. This route can only be used when the business has not yet begun trading in the UK. Alternative options might be available depending on your background. Please get in touch with us to discuss in greater detail the available options.

How do I become a permanent resident of the UK?

Obtaining Indefinite Leave to Remain in the UK usually takes an average of 5 years, depending on which route you are applying under. Once you have lived in the UK for a continuous period of time as required, you can apply for permanent residency.

What is the easiest way to immigrate to the UK?

One of the easiest ways to immigrate to the UK is via a work visa, but for that, you need to meet the eligibility criteria. There are other options available depending on your background. Please get in touch with us to discuss in greater detail the available options.

After Brexit, what is the scope to attain citizenship in the UK? Will the govt become more hostile to immigrant workers in the future or is it safe to plan for the UK?

Nothing much has changed in terms of the scope of obtaining British citizenship after Brexit for migrants from NON-EU countries. In my opinion, the UK Government has no intention to be hostile to migrant workers in the future. Current UK immigration policy appears more liberal post-Brexit.

What is changing in the UK visa process for experienced candidates? Is there no requirement for sponsorship now?

There are many UK immigration categories (with/without sponsorship) to migrate to the UK. Experienced candidates may want to explore the option of Global Talent Visa, Innovator Visa, Skilled Worker Visa.

My dad is 55 years of age and we are willing to go to the UK and start our own business and settle there, are there any possible ways to go to UK?

You may want to explore the self sponsorship route,
